Our Approach
davce.com values creators and respects copyright. We operate as an online service that provides users the ability to upload and share images. We have no interest in hosting infringing content and will respond promptly to valid copyright complaints.
We also strive to be fair and transparent — if content is removed, the uploader will be notified and given the opportunity to submit a counter-notice if they believe the removal was in error.
How to Report an Alleged Infringement
To report a claim of copyright infringement, please send a written notification to our designated Copyright Agent at [email protected] with the following information (required by the DMCA):
- Your full name, postal address, telephone number, and email address.
- A clear identification of the copyrighted work you claim has been infringed (for example, a link to the original or a brief description).
- A list of URLs on davce.com that you claim are infringing (please provide exact links where the material appears).
- A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
- An electronic or physical signature of the copyright owner or a person authorized to act on their behalf.
Takedown Process
Upon receiving a proper DMCA takedown notice, we will:
- Review the notice to ensure it meets statutory requirements;
- Temporarily remove or disable access to the allegedly infringing content;
- Notify the user who posted the content and provide a copy of your notice;
- If appropriate, forward a counter-notice procedure to the user so they may assert their rights;
- Restore content if a valid counter-notice is received and no legal action is taken by the claimant.
Counter-Notice
If content you uploaded is removed and you believe the removal was a mistake, you may submit a counter-notice. A valid counter-notice must include:
- Your name, address, and phone number;
- Identification of the material that was removed and its prior location on the site;
- A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification;
- A statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the U.S., a statement that you will accept service of process from the person who provided the original DMCA notice);
- Your electronic or physical signature.
After receiving a valid counter-notice, we may restore the content within 10–14 business days unless the claimant files a court action to restrain the alleged infringement.
Repeat Infringers
We respect copyright rights holders and will terminate accounts of users who are repeat infringers in appropriate circumstances, consistent with the DMCA.
